1. Acceptance of Terms

By downloading, installing, or using NutriScan+ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

NutriScan+ is a mobile application that provides:

• Barcode scanning for packaged food products
• AI-powered nutritional analysis
• Food consumption tracking
• Health insights and recommendations
• Premium subscription features

3. User Accounts

3.1 Account Creation

• You must sign in using Google authentication
• You must provide accurate information
• You are responsible for maintaining account security
• You must be at least 13 years old to use the App

3.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You may not share your account credentials
• You may not create multiple accounts to circumvent limitations

4. Free and Premium Services

4.1 Free Service

• Limited to 2 AI-powered scans per day
• Access to basic features
• Subject to usage limitations

4.2 Premium Subscription (NutriScan Gold)

• Unlimited AI-powered scans
• Price: LKR 500/month (subject to change)
• Automatically renews unless cancelled
• Billed through Google Play Store
• No refunds for partial months

4.3 Subscription Terms

• Subscriptions automatically renew at the end of each billing period
• You can cancel anytime through Google Play Store settings
• Cancellation takes effect at the end of the current billing period
• No refunds for unused time in current period
• Prices may change with 30 days notice

5. Acceptable Use

5.1 You May:

• Use the App for personal, non-commercial purposes
• Scan products you own or have permission to scan
• Track your own food consumption
• Share content as permitted by the App

5.2 You May NOT:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to circumvent usage limitations (e.g., changing device date)
• Reverse engineer, decompile, or disassemble the App
• Use automated tools to access the App
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Sell, rent, or lease access to the App
• Use the App for commercial purposes without permission

6. Content and Data

6.1 Your Content

• You retain ownership of data you submit
• You grant us license to use your data to provide services
• We may use anonymized data for analytics and improvements
• You are responsible for backing up your data

6.2 Our Content

• All App content, design, and functionality are owned by us
• Product information is sourced from third-party databases
• AI-generated nutritional analysis is provided "as-is"
• Trademarks, logos, and branding are protected

6.3 Third-Party Data

• Product information comes from Open Food Facts and other databases
• We do not guarantee accuracy of third-party data
• Users can report incorrect product information

7. Health Disclaimers

7.2 Accuracy Limitations

• Nutritional data may be incomplete or inaccurate
• AI analysis is automated and may contain errors
• Product formulations change without notice
• Always verify critical information independently

7.3 Allergies and Health Conditions

• The App does not replace allergen label checking
• We are not liable for allergic reactions
• Users with health conditions should consult doctors
• The App is not suitable for medical diagnosis or treatment

8. AI and Gemini API Usage

• The App uses Google Gemini API for AI-powered analysis
• AI-generated content may be inaccurate or incomplete
• You should not rely solely on AI recommendations
• We are not responsible for AI-generated errors
• AI analysis is for informational purposes only

9. Privacy and Data Protection

• Your privacy is governed by our Privacy Policy
• We collect and use data as described in the Privacy Policy
• We use Firebase services for authentication and data storage
• We do not sell your personal information
• You can request data deletion by contacting us

10. Payment and Billing

10.1 Google Play Billing

• All payments are processed through Google Play Store
• You agree to Google Play's payment terms
• Billing is handled by Google, not us directly

10.2 Pricing Changes

• We reserve the right to change subscription prices
• You will receive 30 days notice of price changes
• Continued use after price change constitutes acceptance
• You can cancel before new price takes effect

10.3 Refunds

• Refunds are handled according to Google Play Store policies
• We generally do not offer refunds for partial subscription periods
• Contact Google Play support for refund requests
• Refund eligibility determined by Google Play terms

11. Intellectual Property

11.1 Our Rights

• The App and all content are protected by copyright
• "NutriScan+" name and logo are our trademarks
• You may not copy, modify, or distribute the App
• You may not remove copyright or trademark notices

11.2 Your License

• We grant you a limited, non-exclusive license to use the App
• License is revocable and non-transferable
• License terminates when you stop using the App or violate Terms

12. Third-Party Services

The App integrates with:

• Google Sign-In - Authentication (subject to Google's terms)
• Firebase - Data storage and authentication
• Google Gemini API - AI analysis
• Google Play Billing - Payment processing
• Open Food Facts - Product database

You agree to comply with all third-party terms when using the App.

13. Limitation of Liability

13.2 Maximum Liability

• Our total liability is limited to the amount you paid in the last 12 months
• For free users, our liability is limited to LKR 500 INR
• Some jurisdictions don't allow liability limitations

• NO GUARANTEE OF UNINTERRUPTED SERVICE

• SERVICE MAY BE SUSPENDED WITHOUT NOTICE

15. Indemnification

You agree to indemnify and hold us harmless from:

• Claims arising from your use of the App
• Your violation of these Terms
• Your violation of third-party rights
• Your violation of applicable laws
• Content you submit to the App

16. Termination

16.1 By You

• You can stop using the App at any time
• Delete your account through the App settings
• Cancel subscription through Google Play Store

16.2 By Us

• We may suspend or terminate accounts for Terms violations
• We may discontinue the App with 30 days notice
• We may modify or remove features at any time
• Termination does not entitle you to refunds

17. Changes to Terms

• We may update these Terms at any time
• Changes effective immediately upon posting
• Continued use constitutes acceptance of new Terms
• Material changes will be notified via the App or email
• You should review Terms periodically

18. Dispute Resolution

18.1 Governing Law

• These Terms are governed by the laws of Sri Lanka
• Disputes subject to exclusive jurisdiction of courts in Gampaha, Sri Lanka

18.2 Informal Resolution

• Contact us first to resolve disputes informally
• We will attempt good faith resolution within 30 days

18.3 Arbitration (Optional)

• If informal resolution fails, disputes may go to arbitration
• Arbitration conducted in English in Gampaha, Sri Lanka
• Arbitration fees split equally unless otherwise required by law

20.1 Entire Agreement

• These Terms constitute the entire agreement between you and us
• Supersedes all prior agreements or understandings

• If any provision is invalid, the remaining provisions remain in effect

• You may not assign these Terms
• We may assign these Terms without notice

• We are not liable for failures due to circumstances beyond our control
